These Terms of Service ("Terms") govern your use of thetradepilot.ai and any application, scheduling, or informational services offered through the website (collectively, the "Website"). The Website is operated by TRADE PILOT AI INC, a Georgia corporation with a business address at 161 Peachtree Center Ave, Atlanta, Georgia ("TradePilot AI," "we," "us," or "our"). By using the Website, you agree to these Terms. If you do not agree, do not use the Website.

Website scope

The Website explains TradePilot AI's technology and allows eligible visitors to request information, apply for onboarding, and schedule a call. These Terms govern the public Website. If you purchase a membership, connect a brokerage account, or use the TradePilot platform, additional written terms, an order form, brokerage terms, or other agreements presented during enrollment may also apply. If a specific signed agreement conflicts with these Website Terms, the specific agreement controls for that subject.

Eligibility

You must be at least 18 years old and legally able to enter a binding agreement to use an application, scheduling, or platform-related feature. The Website is not directed to children. You may not use the Website where access to the Website or the described services is unlawful.

No investment advice or offer

Website content is provided for general informational purposes. It is not individualized investment, financial, tax, accounting, or legal advice; an offer or solicitation to buy or sell a security, commodity interest, or other financial instrument; or a recommendation of a Pilot, broker, strategy, or transaction. Nothing on the Website creates an adviser, broker, fiduciary, attorney-client, or tax-adviser relationship.

Trading and copy trading involve substantial risk, including possible loss of all trading capital. Results are not guaranteed, and past performance does not predict future results. The Risk Disclosure and Earnings & Results Disclaimer are incorporated into these Terms by reference.

Applications and calls

Submitting an application or scheduling a call does not guarantee acceptance, availability, suitability, pricing, access, or any result. You agree to provide accurate, current information and to update it when necessary. We may accept, decline, pause, or discontinue an application or onboarding process in our reasonable discretion, subject to applicable law.

Communications sent in response to your request may include email, telephone, or text messages. Marketing texts are sent only where permitted and according to the consent presented when information is collected. Consent to marketing messages is not a condition of purchase.

Acceptable use

You may use the Website only for lawful personal or internal business purposes. You may not interfere with its operation or security; attempt unauthorized access; introduce malware; scrape, copy, or harvest content or personal information through automated means except as allowed by law; impersonate another person; submit false information; evade access restrictions; use the Website to violate another person's rights; or use our name, trademarks, content, or systems to mislead others.

We may restrict or terminate access when we reasonably believe use violates these Terms, threatens the Website or another person, creates legal exposure, or is otherwise abusive.

Intellectual property

The Website, its design, software, text, graphics, logos, videos, and other content are owned by or licensed to TradePilot AI and protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access the Website for its intended purpose. No other rights are granted. TradePilot AI and related marks may not be used without prior written permission.

If you send feedback or suggestions, you grant us a non-exclusive, worldwide, royalty-free right to use them without restriction or compensation, provided we do not publicly identify you without permission.

Third-party services

The Website may use or link to third-party services, including GoHighLevel, LeadConnector, brokerage providers, calendar providers, social platforms, and other websites. Third parties operate under their own terms and privacy practices. We do not control and are not responsible for third-party content, availability, security, execution, pricing, or conduct. A link or integration does not by itself constitute an endorsement.

Privacy

Our Privacy Policy explains how we collect, use, and disclose personal information. By using the Website, you acknowledge that Policy. You are responsible for ensuring that information you submit is lawful and that you have authority to provide it.

Disclaimers

To the fullest extent permitted by law, the Website is provided "as is" and "as available." TradePilot AI disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and uninterrupted operation. We do not warrant that the Website will be error free or that content will remain current. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, TradePilot AI and its officers, directors, employees, contractors, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or opportunities, arising from the Website. Our aggregate liability arising from the public Website will not exceed one hundred US dollars. This limitation does not apply where liability cannot lawfully be excluded or limited, and it does not replace any different limitation in a signed customer agreement.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold TradePilot AI and its officers, directors, employees, contractors, and affiliates harmless from third-party claims, damages, and reasonable costs arising from your unlawful use of the Website, your material breach of these Terms, or information or content you submit in violation of another person's rights.

Changes and availability

We may modify, suspend, or discontinue any part of the Website and may update these Terms. The effective date above identifies the current version. Material changes apply prospectively and will be posted on this page or communicated by another reasonable method. Continued use after an update takes effect constitutes acceptance where permitted by law.

Governing law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Subject to any mandatory rights under applicable law, disputes relating solely to the public Website will be brought in the state or federal courts located in Fulton County, Georgia, and the parties consent to those courts' jurisdiction. Before filing a claim, you agree to contact us and attempt in good faith to resolve the dispute informally.

General terms

If part of these Terms is held unenforceable, it will be limited or removed to the minimum extent necessary and the remainder will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or sale of assets. These Terms and the policies incorporated by reference are the entire agreement concerning the public Website.
